Terms of Service

1. Agreement to Terms

By accessing or using GoShipOrSkip (“Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

GoShipOrSkip is an AI-powered SaaS platform that provides app idea validation by analyzing user reviews from third-party platforms including Product Hunt, Google Play Store, Apple App Store, and Reddit.

2. User Accounts

2.1 Account Creation

To access certain features of the Service, you must create an account by signing in with your Google account. By creating an account, you represent that:

• You are at least 18 years of age or the age of majority in your jurisdiction
• You will provide accurate and complete information
• You will maintain the security of your account credentials
• You are solely responsible for all activity under your account

2.2 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in fraudulent, abusive, or illegal activity. You may delete your account at any time through your account settings.

3. Service Plans and Billing

3.1 Free Plan

We offer a free plan that includes 3 analyses per day. Free plan usage is subject to rate limits and may be modified at our discretion.

3.2 Pro Subscription

Our Pro subscription provides unlimited analyses and additional features. Subscription fees are charged on a recurring monthly basis through Stripe, our third-party payment processor.

3.3 Payments and Refunds

• All fees are in USD and are non-refundable except as required by law
• You authorize us to charge your payment method on a recurring basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to change our pricing with 30 days' notice
• Failed payments may result in service suspension

3.4 Usage Credits

Analysis credits are subject to daily rate limits. Failed analyses may result in credit refunds at our discretion. Credits do not roll over and expire at the end of each billing period.

4. Use of Service

4.1 Permitted Use

You may use the Service to validate app ideas by analyzing publicly available user reviews. You agree to use the Service only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Conduct

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to circumvent rate limits or usage restrictions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access the Service
• Resell, redistribute, or sublicense access to the Service
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or servers
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others

5. AI-Generated Content and Disclaimers

5.1 Nature of Analysis

GoShipOrSkip uses artificial intelligence and large language models to analyze user reviews and generate validation reports. The analysis is based on publicly available review data from third-party platforms.

5.2 No Professional Advice

THE SERVICE PROVIDES INFORMATIONAL CONTENT ONLY AND IS NOT PROFESSIONAL BUSINESS, LEGAL, FINANCIAL, OR INVESTMENT ADVICE. You should not rely solely on our analysis to make business decisions. Always conduct your own research and consult with qualified professionals.

5.3 Accuracy and Completeness

While we strive for accuracy, we do not guarantee that:

• Analysis results are 100% accurate, complete, or current
• AI-generated insights are free from errors or hallucinations
• Third-party review data is representative of all users
• Market signals or trends will continue in the future

5.4 Hallucination Detection

We implement hallucination detection to filter AI-generated quotes that do not appear in source reviews. However, we cannot guarantee that all inaccuracies will be detected.

6. Intellectual Property

6.1 Service Ownership

The Service, including its design, code, algorithms, and content, is owned by GoShipOrSkip and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

6.2 User Input

You retain ownership of the app ideas you submit for analysis. By using the Service, you grant us a non-exclusive, worldwide license to use your input to provide the Service and improve our algorithms.

6.3 Analysis Reports

Generated analysis reports are provided for your personal use. You may share or export your reports, but you may not remove our branding or claim the analysis as your own work.

7. Third-Party Services and Data

Our Service integrates with and collects data from third-party platforms including:

• Product Hunt - OAuth2 API access for posts and comments
• Google Play Store - Public app and review data
• Apple App Store - Public app and review data
• Reddit - Public posts and comments via JSON API
• Google OAuth - Authentication services
• Stripe - Payment processing
• OpenRouter - AI model access

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Data Retention and Caching

We cache review data for 7 days to improve performance and reduce API costs. Cached data is automatically refreshed after expiration. Analysis results are stored indefinitely unless you delete them or close your account.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results will meet your expectations or requirements
• Defects or errors will be corrected
• Third-party data sources will remain available

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSHIPORSKIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

• Your use or inability to use the Service
• Business decisions made based on our analysis
• Errors, inaccuracies, or omissions in AI-generated content
• Unauthorized access to or alteration of your data
• Third-party conduct or content
• Service interruptions or terminations

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless GoShipOrSkip, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any third-party rights
• Any content you submit or generate using the Service

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last Updated” date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Modifications to Service

We may modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any modifications, suspensions, or discontinuations.

14. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court.

You waive any right to participate in class-action lawsuits or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoShipOrSkip regarding the Service and supersede all prior agreements.
